1.Prior to any steps being taken by Build This Fix That Pty Ltd, the customer must provide written approval to proceed with the works. In providing written approval the customer agrees to be bound by these terms and conditions.
Build This Fix That Pty Ltd agrees to provide products and services on the conditions set out in this document.
2.Any quote given to the Customer is valid from 14 days from the date of the quote. Build This Fix That Pty Ltd may at its discretion amend the estimated price if a quote is accepted after 14 days from the date of issue.
3.Material prices included in quotes are based on supply availability. Alternatives may be utilised when particular materials quoted are unavailable at the discretion of Build This Fix That Pty Ltd upon the condition that this will not affect the quality of the works. Where the use of alternative materials will alter the price contained in the quote, Build This Fix That Pty Ltd will give written notice of the price variation to the Customer.
4.Quotes do not include the following items unless these items are expressly listed as a separate named item on the quote:
a.priming or painting of timber and woodwork; and
b.removal and/or disposal of rubbish, construction waste, old appliances, packing materials or other items not brought onto the site by Build This Fix That Pty Ltd.
5.Deposit to be paid as per terms stated on quote. Once approval has been received by Build This Fix That Pty Ltd an invoice for the amount stated will be issued to client. Materials will not be ordered and work will not proceed upon which time deposit, as per quote, has been received.
6.Full payment must be made within 7 days of completion of the works. In the event that payment is not made within 7 days, interest will accrue at 7.5% per annum, calculated daily and Build This Fix That will be entitled to make a payment claim under the Building and Construction Industry Security of Payment Act 1999 NSW.
7.Cancellation of an accepted quote may incur a fee at the discretion of Build This Fix That Pty Ltd.
Guarantees and Exclusions
8.Goods or services supplied by Build This Fix That Pty Ltd come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
9.In addition to the guarantees provided under the Australian Consumer Law, Build This Fix That Pty Ltd guarantees its workmanship for 3 years from the date of completion of the works and during that period will replace or repair (at its discretion) any workmanship which has a material defect which is not the result of ordinary wear and tear, was not caused or contributed to by the Customer and does not arise from the materials used.
10.Subject to the above:
a.to the full extent permitted by law, all warranties, conditions and other terms express or implied by statute or common law are excluded; and
